From Paraguay to Canada, boardrooms to courtrooms, the machine moved swiftly: evidence disappeared, judges looked the other way, and powerful men closed ranks to protect billions at stake. The real crime wasn’t the fraud -it was the cover-up.

Itaipú Binacional, a Brazilian-Paraguayan state-owned energy giant and Guinness World Record holder, has a long history of lacking transparency and political corruption, which is extensively documented and available on the internet. This lack of transparency extends to its pension fund, Cajubi, and has been a cause for concern since the organization’s inception in the 1970s.

Claiming a conspiracy theory and lacking any banking records or expert reports to support its claims, Itaipú convinced a Canadian civil judge that Eduardo García had defrauded its pension fund of more than $20 million by paying kickbacks to several of its directors in a Swiss account. Itaipú publicly offered the pension fund beneficiaries that they would recover all the money from García’s in Canada.  As the years passed without the money being recovered, Itaipú returned to court, this time to demand García’s cooperation in handing over the bank records. However, García couldn’t hand over records for money he never received. The situation was further complicated by Itaipú’s ongoing obstruction of efforts to reveal the names of the alleged “kickback” recipients in Switzerland.

After more than 15 years of relentless pursuit, Itaipú’s fabricated attempts to imprison him over any related actions proved fruitless, a testament to Eduardo’s unwavering integrity. Their latest strategy was driven by a desire to silence him, as he continued to expose the truth in both Canada and Paraguay. The epic struggle between Eduardo and Itaipú cannot be adequately described as a simple case of David versus Goliath; it is far more complex, resembling a confrontation between David and Goliath, alongside an array of formidable adversaries.

Mr. Benítez is a Paraguayan criminal lawyer with 25 years of experience and postgraduate studies. He worked for 15 years at Itaipú, including as a legal consultant.
